These Terms govern your use of osm2cdr.com and every order you place on it. By creating an account or placing an order you accept them. Please also read our Refund Policy and Privacy Policy.
1. Seller
The service is provided and sold by:
Ivan Saroka (Osm2cdr)
Sole proprietorship registered in Poland (CEIDG)
NIP 5372700110 · REGON 546025224
ul. Mikołaja Kopernika 20/39, 21-500 Biała Podlaska, Poland
E-mail: support@osm2cdr.com
2. The Service
osm2cdr.com exports OpenStreetMap map data for an area you select into files (CAD, GIS, vector, 3D, raster and other formats). The result is digital content that is not supplied on a tangible medium: we generate the file on our servers and deliver it online, as a download link in your account and, where applicable, by e-mail. The supported formats are listed in the format catalogue.
3. Account and Wallet
- Some features require an account. You must give a valid e-mail address and keep your sign-in details confidential. You are responsible for orders placed from your account.
- Your account has a wallet. You can top up its balance or buy a package of exports; the cost of each export is deducted from the balance when the export starts.
- The wallet balance is a prepayment for our services. It is not a bank account, does not earn interest and cannot be transferred to another account. Unused balance can be refunded as described in the Refund Policy.
4. Orders, Prices and Payment
- The price of an order and its currency are displayed on the order page before you pay. The amount you confirm there is the total you pay; any taxes that apply are included in it unless the order page states otherwise.
- Card payments are processed by Stripe. We never see or store your full card details.
- The contract is concluded when the payment (or the deduction from your wallet) is confirmed. We send a confirmation by e-mail.
5. Delivery
An export usually completes within minutes; large areas can take longer. If an export fails, the amount charged for it is returned to your wallet or refunded under the Refund Policy.
6. Licence to the Results and OpenStreetMap Attribution
- Map data comes from OpenStreetMap and is licensed under the Open Data Commons Open Database License (ODbL).
- You may use the files you receive for any lawful purpose, including commercial work, subject to the ODbL. Wherever you publish a map or data derived from them, credit «© OpenStreetMap contributors».
- The ODbL applies to the data in the files; it does not transfer rights in our software, website or brand.
7. Acceptable Use
You must not:
- break the law or infringe the rights of others with the service or its results;
- overload the service, bypass usage limits, or access it by automated means other than our published API;
- attempt to gain unauthorised access to our systems or to other users' data;
- resell access to the service itself without our written agreement.
We may suspend or close an account that seriously or repeatedly breaches these rules. Unless the breach is fraud, we refund the unused wallet balance.
8. Right of Withdrawal (EU Consumers)
- If you are a consumer in the European Union, you have the right to withdraw from a distance contract within 14 days without giving a reason (Directive 2011/83/EU).
- Each export is digital content not supplied on a tangible medium. When you start an export, you expressly ask us to begin performance immediately and acknowledge that you lose the right of withdrawal for that export once performance has begun (Article 16(m) of Directive 2011/83/EU). We confirm this in the order confirmation.
- Wallet top-ups and packages that you have not yet used can be withdrawn from within 14 days of payment.
- To withdraw, send an unambiguous statement to support@osm2cdr.com. We refund within 14 days of receiving it, to the original payment method.
- A model withdrawal form is available at /en/withdrawal/.
9. Refunds and Defective Files
If a file is not delivered or does not conform to your order, you have the remedies provided by law for digital content: we first try to fix it (usually by rendering it again), and if that does not work, you are entitled to a refund. The details are in the Refund Policy.
10. Liability
- OpenStreetMap data is produced by volunteers and may be incomplete or out of date. Exports are not suitable as the sole basis for navigation, surveying, legal boundaries or safety-critical decisions.
- For business customers, our total liability for any order is limited to the amount paid for that order, and we are not liable for indirect loss or lost profit.
- Nothing in these Terms limits liability for intentional harm or gross negligence, liability for personal injury, or any right that a consumer has under mandatory law.
11. Complaints and Dispute Resolution
- Send complaints to support@osm2cdr.com with your order number and the e-mail address of your account. We reply within 2 business days; complaints are decided within 14 days at the latest.
- The EU Online Dispute Resolution (ODR) platform was closed on 20 July 2025. If we cannot settle a complaint, a consumer may refer it to an out-of-court (ADR) body, for example the Trade Inspection (Inspekcja Handlowa) in Poland or a consumer body in the consumer's own EU country, or ask the European Consumer Centre for help with a cross-border dispute. Taking part in ADR is voluntary; we will tell you in our reply whether we agree to it.
12. Governing Law
These Terms are governed by Polish law. If you are a consumer living in another EU country, you keep the protection of the mandatory consumer law of that country. Consumers may bring proceedings in the courts of their country of residence.
13. Changes to These Terms
We may update these Terms, for example when the law or the service changes. We announce material changes by e-mail or on the site at least 30 days before they take effect. Orders already paid are governed by the version in force at the time of the order. If you do not agree with a change, you may close your account and ask for a refund of the unused balance.
